In this privacy statement (the ?Privacy declaration?) we explain which personal data of applicants and employees are processed, for what purpose and how you can exercise your privacy rights. The Residence 053 considers your privacy important. We therefore process your personal data carefully and comply with the applicable laws and regulations.

1. Applicability of Privacy Statement

The Privacy Statement applies to all activities and actions of The Residence 053 related to applicants and employees. Attachment 1 to this Privacy Statement contains a list of the hotels and restaurants covered by this Privacy Statement.

The Residence 053 informs applicants and employees about the processing of personal data, including via vacancy websites, web pages and various (digital) employee platforms. In addition, a new employee is made aware of this Privacy Statement when entering into an employment contract.

2. What is the purpose and basis of the processing?

The Residence 053 processes different types of personal data for different purposes. Below it is explained which personal data are processed for what purposes.

1. Recruitment and selection of candidates

The Residence 053 processes personal data in the context of an effective and efficient recruitment and selection process of new employees. The processing takes place with your permission by sending your CV and motivation letter, as well as because we have a legitimate interest in this (recruitment and selection of personnel).

1. Personnel administration

As an employer, The Residence 053 maintains personnel administration for the registration and updating of personnel data. We do this in the context of personnel management. This concerns data that is necessary for the execution of the employment contract and that must be recorded on the basis of a legal obligation.

The Residence 053 maintains salary and hour administration for paying salaries. This concerns processing that is necessary for the execution of the employment contract and to which The Residence 053 is also legally obliged.

1. Absenteeism registration and policy

The Residence 053 keeps track of the absenteeism of its employees as part of its payroll administration, as well as for the prevention of absenteeism and to promote reintegration. These processing operations are necessary to comply with legal obligations and are necessary for the execution of the employment contract. The Residence 053 distributes newsletters and relevant personnel information to employees via e-mail. We collect your email address in order to share these newsletters and information with you with your permission.

The Residence 053 will process the following categories of personal data:

1. identification and contact details such as title, name, address, place of residence, date of birth, e-mail address and telephone number and any employment documents;
2. training and application data such as CV, motivation letter, education, courses, assessments, references;

4. other data that you have voluntarily and additionally provided to us, such as a photo, information about your interests, hobbies and others.

4. proof of identity and BSN;
5. clothing and shoe size;
6. salary data, payroll tax form, time registrations, short-term and long-term leave, absenteeism and other data relevant to payroll administration;
7. data relating to your performance;
8. interaction data such as IP address, surfing behavior on The Residence 053 websites, click behavior, cookie ID and contact with The Residence 053; and
9. other data that you have voluntarily and additionally provided to us, such as photos, information about your interests, hobbies and others.

5. To whom does The Residence 053 provide personal data?

The Residence 053 only provides personal data to other parties to facilitate and carry out the processing mentioned under point 2. Below you will find an overview of (the categories of) recipients.

1. the relevant branch where you are applying;
2. (IT) service providers and software companies;
3. enforcement agencies such as the police, the judiciary or anti-fraud organizations;
4. the Occupational Health and Safety Service;
5. the UWV;
6. the payroll administrators and controllers of The Residence 053.

In addition, The Residence 053 may share personal information to:

– comply with applicable laws and regulations;

– respond to government requests or court orders;

– comply with valid legal procedures;

– to safeguard the rights, privacy, safety or property of The Residence 053, guests or employees;

– respond to an emergency.

We ensure that data is only shared if the third party processes the data based on our instructions, takes sufficient appropriate (security) measures and guarantees that we comply with the applicable privacy laws and regulations.

6. Transfer of personal data outside the EEA

The Residence 053 can transfer personal data from the Netherlands abroad. Where personal data is processed by us outside the EEA, we will ensure an adequate level of protection for the data transferred. Van der Valk uses Google Analytics. The last part of the website visitor's IP address is masked. We do not share any other data with Google via Google Analytics.

8. How long does The Residence 053 store personal data?

The Residence 053 does not store personal data for longer than necessary for the purposes stated above, unless there is a legal obligation to retain the data or you have given permission for the retention period.

Applicant data will not be used for longer than four weeks after completion of the application procedure, unless you consent to a longer storage period.

9. Security and measures

The Residence 053 maintains a high level of security for applicant and employee data. The Residence 053 takes appropriate organizational and technical measures to ensure confidentiality and availability, as well as to prevent unlawful processing of personal data. Access to data by employees of Van der Valk is based on necessity given the position of the employees in question (Need to know principle). The Residence 053 periodically tests the security of its data processing and underlying IT systems. In the event of outsourcing data processing processes to third parties, we make agreements with these parties regarding adequate security of personal data. The measures taken are in line with applicable privacy laws and regulations. However, absolute (100%) security of personal data cannot be guaranteed. If a security incident occurs despite the security measures taken, we will take measures to limit the consequences for your privacy as much as possible.

10. Liability

In view of the aforementioned under point 9, The Residence 053 cannot be held responsible or liable for unauthorized, unauthorized or unwanted processing and/or access to personal data that cannot be attributed to The Residence 053. We are also not responsible for the actions or omissions of third parties with whom we collaborate or to which we refer on our website(s) or otherwise. The relevant third parties are not covered by this Privacy Statement and we therefore recommend that you carefully read the privacy statements of these third parties on the websites. In all the aforementioned cases, The Residence 053 accepts no liability and an applicant or (former) employee is not entitled to compensation, compliance or any other claim against The Residence 053.

11. Your privacy rights

As an applicant or employee at The Residence 053, you can request access, correction, deletion, objection, restriction or transfer of personal data. You also have the right to withdraw any permission you have given. Any withdrawal of your consent will not affect previous processing based on it.

You have the right to ask The Residence 053 whether we process your personal data. If we process data about you, you have the right to inspect the personal data concerned, the purposes of the processing, possible sources or recipients of this personal data and the retention period.

1. Right to rectification

If it becomes clear that the data is incorrect, you can submit a request to have it corrected.

1. Right to deletion

You can request us to delete personal data collected by us in the following cases:

• the personal data are no longer necessary for the purposes for which we collected or otherwise processed them;
• if the consent on the basis of which the processing takes place has been withdrawn by you;
• the personal data is processed unlawfully by us;
• we must delete your personal data based on a legal obligation;
• we have collected your data through mobile telephony or internet services.

1. Right to restriction

If you have reported an inaccuracy in your personal data to us or if you have objected to the processing, you can request us to restrict the processing as long as we are processing your request. You can also request us to restrict processing if you believe that we are processing your data unlawfully or no longer need it for the processing purposes and you need it for a legal claim.

1. Right to portability

If the processing takes place on the basis of your consent or the processing is carried out via automated processes, you can request us to transfer your personal data to you. You can also ask us to transfer this data directly to another controller.

1. Right to object

You have the right to object at any time to the processing of personal data relating to you. This applies in particular to profiles that we have created based on your personal data or if we use your personal data for direct marketing purposes.

Exercising rights

If you wish to exercise one or more of your rights listed above, you can do so only by sending an email to the email address of the relevant hotel (see Appendix 1 to the Privacy Statement). Your request must meet legal requirements. We may require you to identify yourself before we process a request. The Residence 053 will inform you of its decision within four weeks, unless we inform you within that period that we need more time.

Please note that The Residence 053 may, under certain circumstances or based on applicable (privacy) laws and regulations, refuse to comply with your request in whole or in part.

12. Identity and Contact Details

Please indicate clearly in the subject that it concerns privacy and which request it concerns so that we can respond within the applicable periods. This authority is authorized to take note of your complaint and may decide to process the complaint further.

13. Changes to the Privacy Statement

The Residence 053 may make changes to the Privacy Statement. Changes to the Privacy Statement will be announced directly via the websites mentioned in Appendix 1 and will immediately, fully and fully apply to the privacy policy of The Residence 053. The Residence 053 therefore recommends that you regularly check whether there have been any changes.

14. Applicable law and competent court
